Section 298A of the Malaysian Penal Code ~ JAKIM or the Royal Malaysian Police has the authority to use it?

Yesterday, I had an interesting conversation with one of our nation's distinguished law practitioner with regard as to why it seems that people who bad mouth or blaspheme against Islam are seen to be at liberty to say what they damn well please without any prompt affirmative action taken against them as in the case where a couple of 'Muslim' lawyers have been uttering all kinds of nonsense about Islam in public?

My learned friend told me that JAKIM @ Jabatan Kemajuan Islam Malaysia or the Malaysian Islamic Development Department under the auspices of the Prime Minister's Department do not have the clout to take any action against these troublemakers.

It is but the Royal Malaysian Police who do have such powers to take these shit-stirrers (so to speak) to account. 

My question is why have they been silent about it? Do they really need to wait till all havoc breaks loose? Do they have to wait for someone to lodge a police report first before they do take any action? Do they not have the power to take any preemptive action on their own to nip the problems in the bud?

I was sad to know that our nation's topmost religious authorities have been not given their rightful powers to act against the blasphemers but those powers are accorded to our Royal Malaysian Police who in my opinion would be ill-equipped as far as religious knowledge is concerned to take lawful action against those who blaspheme against our faith of Islam and its tenets.

Its akin  to allowing these foul-mouthed lawyers to freely run riot with their harmful disbelief and poison the hearts and minds of the clueless and impressionable ones in our society with their foul diarrhea of their lips.

I was told to refer to the following Section 298 and 298A of our Malaysian Penal Code ACT 574 which describes in detail as to the laws and provisions in dealing with such crimes.

Uttering words, etc., with deliberate intent to wound the religious feelings of any person

298. Whoever, with deliberate intention of wounding the religious feelings of any person, utters any word or makes any sound in the hearing of that person, or makes any gesture in the sight of that person, or places any object in the sight of that person, shall be punished with imprisonment for a term which may extend to one year or with fine or with both. Causing, etc., disharmony, disunity, or feelings of enmity, hatred or ill will, or prejudicing, etc., the maintenance of harmony or unity, on grounds of religion.

298A. (1) Whoever by words, either spoken or written, or by signs, or by visible                  representations, or by any act, activity or conduct, or by organizing,                      promoting or arranging, or assisting in organizing, promoting or                            arranging, any activity, or otherwise in any other manner—

(a) causes, or attempts to cause, or is likely to cause disharmony, disunity, or               feelings of enmity, hatred or ill will; or

(b) prejudices, or attempts to prejudice, or is likely to prejudice, the maintenance       of harmony or unity, on grounds of religion, between persons or groups of           persons professing the same or different religions, shall be punished with             imprisonment for a term of not less than two years and not more than five             years.

(2) Sections 173A and 294 of the Criminal Procedure Code shall not apply in respect of an offence under subsection (1).

(3) Where any person alleges or imputes in any manner specified in subsection            (1) — 162 Laws of Malaysia ACT 574
            (a) that any other person, or any class, group or description of persons,                        professing any particular religion  —
                (i) has ceased to profess that religion;
                (ii) should not be accepted, or cannot be accepted, as professing that                            religion; or
               (iii) does not believe, follow, profess, or belong to, that religion; or
           (b) that anything lawfully done by any religious official appointed, or by                    any religious authority established, constituted or appointed, by or                        under any written law, in the exercise of any power, or in the discharge                  of any duty, or in the performance of any function, of a religious                            character, by virtue of being so appointed, established or constituted,                    is not acceptable to such person, or should not be accepted by any                          other person or persons, or does not accord with or fulfill the                                  requirements of that religion, or is otherwise wrong or improper, he                      shall be presumed to have contravened the provisions of subsection (1)                  by having acted in a manner likely to cause disharmony, disunity or                      feelings of enmity, hatred or ill will, or likely to prejudice the                                maintenance of harmony or unity, between persons or groups of                            persons professing the religion referred to in the allegation or                                imputation.

(4) (a) Where, on any ground of a religious character, any person professing any particular religion uses for burial or cremation of any human corpse a place other than one which is lawfully used for such purpose by persons professing that religion, he shall be presumed to have contravened the provisions of subsection   (1) by having acted in a manner likely to cause disharmony, disunity or feelings of enmity, hatred or ill will, or likely to prejudice the maintenance of harmony or unity, between persons or groups of persons professing that religion.    

(b) Where any person, on any ground of a religious character, counsels, advises, instigates, urges, pleads with, or appeals or Penal Code 163 propagates to, or in any manner or by any means call upon, whether directly or indirectly, any other person or persons professing any particular religion—

      (i) to use for burial or cremation of any human corpse a place other than one              which is lawfully used for such purpose by persons professing that                        religion;

     (ii) not to use for burial or cremation of any human corpse any place which is            lawfully used for such purpose by persons professing that religion; or

    (iii) not to use for worship any place which is lawfully used for such purpose              by persons professing that religion, he shall be presumed to have                          contravened the provisions of subsection (1) by having acted in a manner              likely to cause disharmony, disunity or feelings of enmity, hatred or ill                  will, or likely to prejudice the maintenance of harmony or unity, between              persons or groups of persons professing that religion or different                            religions.

(5) Where any person who is not a religious official appointed, or a religious authority established, constituted or appointed, by or under any written law purports to exercise any power, or to discharge any duty, or to perform any function, of a religious character, being a power, duty or function which can be lawfully exercised, discharged or performed only by a religious official appointed, or a religious authority established, constituted or appointed, by or under any written law, he shall be presumed to have contravened the provisions of subsection (1) by having acted in a manner likely to cause disharmony, disunity or feelings of enmity, hatred or ill will, or likely to prejudice the maintenance of harmony or unity, between persons or groups of persons professing the same or different religions.

(6) The foregoing provisions of this section shall not apply to —
      (a)  anything done by any religious authority established, constituted or                        appointed by or under any written law and conferred by written law with              power to give or issue any ruling or decision on any matter pertaining to              the religion 164 Laws of Malaysia ACT 574 in respect of which the                      authority is established, constituted or appointed; or

      (b) anything done by any person which is in pursuance of, or which accords               with, any ruling or decision given or issued by such religious authority,                  whether or not such ruling or decision is in writing, and if in writing,                    whether or not it is published in the Gazette.

(7) It shall not be a defense to any charge under this section to assert that what the offender is charged with doing was done in any honest belief in, or in any honest interpretation of, any precept, tenet or teaching of any religion. (8) If in any proceedings under this section any question arises with regard to the interpretation of any aspect of, or any matter in relation to, any religion, the Court shall accept the interpretation given by any religious authority referred to in subsection (6), being a religious authority in respect of that religion.


I wonder why has the Royal Malaysian Police not considered handing over such authority which is not in their field to JAKIM which would be better positioned to deal with such cases?

Islamic State? There's no bloody anything 'Islamic' in it! What about Christian, Buddhist or Hindu Terrorists?

There is nothing 'Islamic' about a group that wages terror and bloodshed in the name of my faith! You shouldn't associate the only revealed faith from Almighty God as the Way of Life for all Mankind to this barbaric attack against innocents!

Just like you wouldn't want to link the Ku Klux Klan with Christianity or the murderous rampaging monks who committed rape, mass murder and torture of the Rohingya Muslims with Buddhism or the hordes of RSS thugs and goons who massacred the Gujerati Muslims with Hinduism,etc.

These lunatics and barbarians have nothing to do with the said religions that they are associated with by the cherry picking agitating media.

When it comes to any so called Muslim lunatic who commits any acts of crime like in this case, the media are all up in arms and broadly labels such acts as 'Islamic Terror'!

Even though it was widely reported and covered, identifying the terrorist as a white Christian Norwegian far-right wing terrorist to be Anders Behring Breivik, the biased media STILL CHOSE TO INSERT THAT MISLEADING 'AL-QAEDA MASSACRE' sub-heading on their front-page!!!

Are they not bloody hypocrites???

You don't hear us lambasting all other Christians for his sins, do you?

Let's take a look at the latest 'terror' attack on civilians over there in London, England. 

This Khalid Masood is a British born lunatic. Acts of a deranged person same as Anders Breivik and all other crazy killers out there. 

There's nothing 'Islamic' about this mass murderer except that he bears a Muslim name. True Muslims don't go around killing innocent people!

Britain and all other countries of the world have to nip these terror problems in the bud and regulate their own citizens and not give any of these these troublemakers room to grow.

Prevention is always better than trying to cure!

Sekolah Jenis Kebangsaan di antara punca rakyat Malaysia jadi rasis dan prejudis?

Sebelum Semenanjung Tanah Melayu ini merdeka dari penjajahan British, rata rata penduduk Tanah Melayu ini hidup didalam rukun damai dan dapat menerima kehadiran satu sama lain didalam ertikata mencari rezeki secara bekerja kuat didalam bidang masing masing.

Orang orang Melayu, ramai yang bekerja sebagai pesawah, ada yang berkebun, bertani, penoreh getah, nelayan dan peniaga kecil. 

Ada pula bangsa Cina yang sebelum kedatangan penjajah Inggeris telah datang berniaga kain serta pelbagai peralatan kegunaan seharian dan perusahaan di Semenanjung Tanah Melayu ini dengan menjaja barangan runcit dari kampong ke kampong dan ada yang membuka kedai di pekan pekan serta bandar bandar di seluruh tanahair ini.

Orang orang India dari zaman Kesultanan Melayu Melaka ada yang datang belayar membawa barang dagangan berupa rempah ratus dan bekerja di pelabuhan sebagai buruh kasar dan sebagainya.

Zaman saya belajar di sekolah rendah dahulu (1965-1970) dan di sekolah menengah (1971-1976) tidak ada pengasingan para pelajar dari segi bangsa dan agama. 

Sepanjang pengalaman saya belajar bersama kawan kawan Melayu, Cina, India dan lain-lain bangsa dan kepercayaan agama, masing masing saling hormat menghormati dan bertoleransi di antara satu sama lain.

Kesepakatan terjalin kukuh dan kemesraan di antara kami memang wujud dan ikhlas. Kaya dan miskin sama sama belajar di dalam suasana harmoni dan tidak ada perbuatan membezakan atau mendiskriminasi sesiapa dari segi apa pun jua.

Zaman itu boleh di katakan kehidupan kami sebagai rakyat dan warga Malaysia memang aman dan selesa walau berbeza bangsa, agama dan status sosial.

Sejak negara kita merdeka dari penjajahan British, ada usaha untuk ketiga tiga bangsa utama di tanahair kita ini iaitu Melayu, Cina dan India untuk mewujudkan sekolah2 jenis kebangsaan dan institusi pendidikan masing masing sekaligus mengujudkan jurang perbezaan ketara di antara kaum2 utama rakyat Malaysia ini.

Hilang lah sudah segala usaha untuk menyatupadukan masyarakat kerana dari bangku sekolah rendah lagi sudah tidak bercampur gaul dan berpeluang untuk memahami dan menghayati segala adat budaya dan resam kaum yang lain.

Maka terpisah lah sebahagian besar dari masyarakat kita dari satu sama lain terutamanya kaum Cina yang sebahagian besar dari mereka seolah menjadi orang asing di dalam negara kita sendiri. 

Saksikan kedangkalan mereka berbahasa Melayu walau sudah terlantik ke jawatan penting sebagai wakil rakyat dan Ahli Dewan Undangan Negeri! :P

Apakah puncanya? Ianya bermula dari peringkat anak anak mereka masih kecil lagi!

Anak2 mereka di masukkan ke tadika dan sekolah jenis kebangsaan Cina sahaja dan di asuh bertutur didalam Bahasa Mandarin sahaja. 

Akibatnya anak2 Cina ini tidak tahu berbahasa Melayu dan menjadi bagaikan kera sumbang sahaja. Tidak tahu cara bergaul dan bermesra dengan jiran tetangga dari kaum2 Melayu, India dan lain2.

Ahli2 Parlimen yang berbangsa Cina terbukti amat lemah penguasaan Bahasa Kebangsaan mereka dan terserlah didalam sesi perbahasan di dalam Dewan Rakyat di Parlimen Malaysia. Saksikan suatu contoh:

Orang2 berbangsa India tak lah seteruk rakan senegara mereka yakni Cina dan kebanyakan rakyat Malaysia yang berketurunan India boleh berinteraksi dengan elok sesama warganegara.

Mahu tak mahu kerajaan Malaysia perlu merapatkan kembali jurang di antara masyarakat kita dengan cara manyatukan semua aliran sekolah2 dari jenis kebangsaan sekarang ke konsep sekolah 1Malaysia dan mengadakan kelas2 khas untuk pembelajaran bahasa2 ibonda kaum2 tertentu serta adat resam masing-masing terus subur dan di teruskan.

Insya Allah, saya percaya kerukunan dan keharmonian di antara kaum didalam negara kita ini akan lebih erat dan padu.

* This article is being typed at a 200% magnification! I just underwent a cataract surgery on my left eye at the Kuala Lumpur Hospital on the 8th of March 2017.

I have yet to come across any Medical doctors here in Malaysia who would be so willing to update me about my health conditions and what to expect from the medical treatments and procedures here in Malaysia! 


You would be extremely lucky if the doctors here would even spend a few minutes to brief you in as detailed a manner as you find the medical professionals do in at


I think that our doctors here assume that their patients wouldn't know a thing about what they are suffering from and that even if they did try to explain to you they would do so in a very condescending manner.

They would think that patients here are clueless and ignorant. Well, I beg to differ. This is a very well informed patient. Yes sirree! 

I do study a lot about what I am suffering from and what I can expect from the way I am treated here in our Malaysian health services.

In this age of advanced Science & Technology, valuable and useful information such as these should not be kept just to the access of medical professionals only.

As people who suffer from all kinds of ailments and conditions, we need to know what we are suffering from and how we should go about getting the right treatments and from whom?

I remember my late father who being poor and not in the know resort to all kinds of traditional methods further harm his poor vision and he ended up almost blind prior to his passing away.

Well, I am fortunate enough not to suffer the same fate. Using whatever knowledge that I have come to acquire on my own, I seek treatment that I can afford and take a very deep interest with what I am subjecting myself to and listen earnestly to what the doctors are saying and the diagnosis that they conclude about my condition.

To know is to be sure that there is no misdiagnosis. There should be no room for 'Oops! We are so sorry!' when it comes to our treatment procedures. Don't you agree?

Lee Kuan Yew's fortitude & mastery ~ Will we ever see such a leader emerge here in Malaysia?

For someone like me who misses such a dynamic strong leadership like that shown by our nation builder as in the person of Tun Dr. Mahathir Mohamad and Singapore's founding Father the late esteemed Lee Kuan Yew, getting to watch such exhilarating videos such as this reminds me how we really need to raise and nurture strong, dynamic citizens capable of leading our beloved country to it's deserved position as one of this region's most progressive nation as what we were promised by Tun Dr. Mahathir's Vision 2020!

The way Lee Kuan Yew stands his ground and defend his Singapore Government's decision to put troublesome and meddling 'offshore' American press such as the 'Asian Wall Street Journal' in its place, truly ought to be made as a benchmark of political science reference material.

I do not see that many current so called leaders here in Malaysia possess such fine leadership qualities such as what our Tun Dr. Mahathir and Singapore's Lee Kuan Yew possess.

Only true statesmen like our two countries @ Singapore and Malaysia illustrious nation builders in the form of Lee Kuan Yew and Tun Dr. Mahathir qualify to be recognized as such.

Our current blemished leaders pale in comparison to such fine politicians. Yes, they were labeled as dictators, strongmen and such but look at what they did for both Singapore and Malaysia compared to what our nations were back in the days of the British Colonial era and before that?

Malaya and Singapore were then pillaged and looted of its riches and were mere vassals of the British Colonial Empire. Singapore had nothing to speak of in terms of natural minerals or even petroleum back then. 

Lee Kuan Yew turned that once stinking marshland and polluted port into being one of this region's leading economies! We were once known as a 3rd world agricultural backwater.

Tun Dr. Mahathir Mohamad through his firm and dynamic leadership turned Malaysia into what it is now, a strong emerging industrialized nation but the current leader made us infamous with the scandalous 1MDB case which he is accused of playing the main part. I don't think that case will get settled within my lifetime.

Strong leaders like Lee Kuan Yew and Tun Dr. Mahathir are rare and quite hard to come by. Our country's aspiring politicians ought to study and emulate these great icons struggle in turning both Singapore and Malaysia around.
